The basic meaning of the following is that Proimageguide is going to provide you with a service and will make every effort to ensure the reliability of this service. By doing so, we reserve the right to take any measure necessary to keep the service available to our customers. Proimageguide allows users to create and manage their very own professional online portfolio all through a simple web-based interface. It is intended to allow users to create and update their website without the need to learn HTML or any other complex scripting language.

Any images uploaded by a user remain the property of that user or whatever party holds the copyright. By uploading images, a user does not surrender his/her copyright or ownership of the images.

You agree not to use or allow access to Proimageguide services to:

1. Create or maintain software download or distribution sites or sites created for the purpose of mass distribution of software products. A software distribution site is defined as a site on which 50% or more of total bandwidth (data transfer) is used for programs or binary code downloads.

2. Violate any applicable laws, regulations, or other provisions having the force of law, either intentionally or unintentionally.

3. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

4. Employ misleading e-mail addresses or falsify information in any part of any communication.

5. You agree not to take advantage of this service by registering for a second free demo account. Our free demo is available to new customers for a complete test drive of our product and service. By continuing to register for the free service after you have been notified that your demo account will be disabled, Proimageguide has the right to take any necessary legal action.

6. Upload, transmit, disseminate, post, store or links to any content that: 

• Prohibited from transmitting or posting by law, or by contractual or fiduciary relationship;
  
• Facilitates hacking or unauthorized access or use of data, systems, servers or networks including any attempt to probe, scan or test for vulnerabilities, or to breach security or authentication measures;
  
• Falsifies origin by forging TCP/IP packet headers, e-mail headers, or any part of a message header, unauthorized monitoring of data or traffic;
  
• Interferes with service to any user, system or network by using flooding techniques, overloading a system or a network, staging or broadcasting an attack, or any other means resulting in a crash of a host either deliberately or by negligence;
  
• Infringes or contributes to any infringement of any intellectual property, material protected by copyright, trademark, patent, trade secret or proprietary right of any party;
  
• Is or may be considered unsolicited or unauthorized advertising, promotional materials, or any junk mail, spam, spamvertisements, make money fast schemes, chain letters, pyramid schemes, or any other form of solicitation;
  
• Contains viruses, worms, Trojan horses, time bombs, trap doors, or any other computer code, files, or programs or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  
• Is unlawful, harmful, threatening, abusive, harassing, tortuous, unlawful, libelous, defamatory, vulgar, obscene, or invasive of privacy;
  
• Is of adult nature, pornographic, or harmful to minors;
  
• Promotes illegal activity, including providing instructions for illegal activity, or transmitting, disseminating or offering fraudulent goods, services, schemes or promotions, or furnishing false data on any signup form, contract or online application or registration, or the fraudulent use of any information obtained through the use of the Services including use of credit card numbers.
  
• Exploits the images of children or discloses personally identifiable information belonging to children.
  

There is no guarantee of privacy.

Proimageguide has some features that reduce the possibility of unwanted people viewing the images, but it is possible for someone to find a way to circumvent these measures. If it is important that an image should not be seen by the public, do not put the image on your website. 

Proimageguide reserves the right to remove or categorize images in any way it sees fit. If a user uploads something of questionable legality or taste, it may be removed without notice. Users agree to accept all liability for the legality of content they submit and will not hold Proimageguide responsible for any damages that result.

There is no guarantee of performance.

Proimageguide will make every effort to provide a stable and reliable site.

Proimageguide has redundancy or fault-tolerant systems and does regular backups of site contents. If however something catastrophic occurs and everything is destroyed, users have no right to demand anything of Proimageguide.

Usage Limits:

Proimageguide offers an unlimited disk storage plan for images. Until such time that disk and bandwidth usage begins to seriously degrade performance, there are no plans to change this offering.

In the event that a problem occurs or if Proimageguide believes there is a degradation in performance or reliability, Proimageguide will do whatever is necessary to keep everything running well.

If Proimageguide determines that you have violated the terms of this policy, that determination, made at Proimageguide’s sole discretion, is grounds for immediate termination of your Proimageguide account without notice or penalty to Proimageguide.
